CALIFORNIA CONSUMER PRIVACY ACT

The California Consumer Privacy Act (CCPA), enacted in 2018, creates new consumer rights relating to the access to, deletion of, and sharing of personal information that is collected by businesses. 

Under the California Consumer Privacy Act (CCPA), California residents have the following data rights:

  • The right to know about the personal information a business collects about them and how it is used and shared;
  • The right to delete personal information collected from them (with some exceptions);
  • The right to opt-out of the sale or sharing of their personal information; and
  • The right to non-discrimination for exercising their CCPA rights.

In November of 2020, California voters approved Proposition 24, the CPRA, which amended the CCPA and added new additional privacy protections that began on January 1, 2023. As of January 1, 2023, consumers have new rights in addition to those above, such as:

  • The right to correct inaccurate personal information that a business has about them; and
  • The right to limit the use and disclosure of sensitive personal information collected about them.

CPRA amends the CCPA; it does not create a separate, new law.

VIRGINIA CONSUMER PRIVACY ACT

The Virginia Consumer Data Protection Act (VCDPA) also provides consumers with certain rights related to their personal data. Under the Act, these rights include:

  • The right to know, access and confirm personal data.
  • The right to delete personal data.
  • The right to correct inaccuracies in personal data.
  • The right to data portability (i.e., easy, portable access to all pieces of personal data held by a company).
  • The right to opt out of the processing of personal data for targeted advertising purposes.
  • The right to opt out of the sale of personal data.
  • The right to opt out of profiling based upon personal data.
  • The right to not be discriminated against for exercising any of the foregoing rights.

How We Collect Your Personal Information

We accept and store any information that you submit on Audio46.com or by any other means, including when you directly provide information to us and when we automatically collect information about you through your use of the Services. In some instances, you may be able to choose what information to provide, but sometimes we require certain information from you to use certain features of the Services.

At the time of collection, we will clearly identify the information being collected and the purposes for which it will be used. For example, to create an account you provide data including your name, email address and/or mobile number, and a password. It is always your choice whether or not to provide Personal Information. Your choice not to provide certain other Personal Information may mean that you will not be able to use certain features of the Services.

Right to Delete

We take great care to protect your privacy but we understand if you'd like us to delete your personal information. California residents have the right to request that we delete any of your personal information that we collected from you and retained, subject to certain exceptions. Once we receive and confirm your verifiable consumer request, we will delete (and direct our service providers to delete) your personal information from our records, unless an exception applies.

  • We may deny your deletion request if retaining the information is necessary for us or our service provider(s) to:

Audio46 shall ensure that any third party to which we disclose personal information provides the same level of privacy protection as is required by the Privacy Shield Principles and agrees in writing to provide an adequate level of privacy protection.

  • Within our company to provide you with our Services.

Data Retention

We retain the personal data you provide while your account is in existence or as needed to provide you Services. We will retain personal data we process on behalf of our Clients for as long as needed to provide services to our Clients. Audio46  will retain this personal information as necessary to fulfill the purposes described in this Privacy Policy, comply with our legal obligations, resolve disputes, and enforce our agreements. Data can be removed upon request of a customer at the end of a predetermined agreement, subject to any applicable statutory exceptions.

Other data is deleted or anonymized automatically after a set period of time, such as advertising data in server logs. Some data we retain for longer periods of time when necessary for legitimate business or legal purposes, such as security, fraud and abuse prevention, or financial record-keeping.

When you delete data, we follow a deletion process to make sure that your data is safely and completely removed from our servers or retained only in anonymized form. We try to ensure that our services protect information from accidental or malicious deletion. Because of this, there may be delays between when you delete something and when copies are deleted from our active and backup systems.

We cannot respond to your request or provide you with personal information if we cannot verify your identity or authority to make the request and confirm the personal information relates to you.
